This Privacy Policy applies to all personal data that we process and to all domains related to us. This concerns the personal data of everyone who has ever had contact with us, visited our website or use our products/services, such as visitors, customers, training participants and business contacts. There are several bases on which we can process personal data. These are: the execution of an agreement, the legitimate interest, based on a legal obligation or on the basis of your permission. We process your personal data to the extent necessary to achieve the purpose for which we collect the personal data.

We process the personal data of everyone who has had contact with us, visited our website or use our product/services. These include visitors, private customers, business customers and contact persons of our partners. In addition, we process personal data of clients of our customers, after they have given written consent. These are persons who (can) suffer from certain health care problems (particularly stress and stress related complaints, such as fatigue, pain, burn-out and depression) and who participate in a health care intervention or training program of one of our customers in order to optimize their health, wellbeing and/or personal development.

We collect the following data you provide us with directly:

We collect data that your browser sends whenever you visit our website. Analytics services (non-personally identifiable information only)

We use third-party analytics tools to help us measure traffic and usage trends for the website. These tools collect data sent by your device or our website, including the web pages you visit, add-ons, and other information that assists us in improving the website. The tools use ‘cookies’, which are text files placed on your device, to collect your log information and behavior information in an anonymous form. We collect and use this analytics data with analytics information from other Users so that it cannot reasonably be used to identify any particular individual User.  8. What do we use your data for?

 

We only use your personal data for the purpose for which we are allowed to use it:

  • We have received your permission to use your personal data.

  • We use your data because we want to give you the best service as a customer and cannot do without it’s information (e.g. send you and invite to fill in our survey).

 

More specifically, we use your personal data that is collected via our survey for:

  • Feedback: giving you feedback of your personal scores, in order to become aware of your stress level and its causes and consequences, as well as your development therein.

  • Guidance: giving your trainers/coaches feedback of your personal scores, so that they can guide and support you better in optimizing your health and wellbeing and monitor your personal development (due to their profession, trainers/coaches are bound by professional secrecy and as such, will treat personal data strictly confidential).

  • Research: using your processed anonymized personal data (which cannot be traced back to you as an individual) for research on stress and its causes and consequences and the effectiveness of health care interventions on preventing and reducing stress and optimizing health and wellbeing.

  • Knowledge: sharing anonymized research results (which cannot be traced back to you as an individual) with our customers, partners and other stakeholders to increase their knowledge on how to prevent and reduces stress and optimize health and wellbeing, as well as publishing those results so that the knowledge becomes available for a wider population.

 

Note that we use your personal registration numbers or IP-address to link your personal data that is collected at different moments in time and to search, identify and check your data in the database when needed, for instance to retrieve or delete your data (an IP address is not used for other purposes).

Finally, we use all the information we have to help us provide and support our website and products/services. Here is how:

  • remember information so you will not have to re-enter it during your visit or the next time you visit the website;

  • make the use of our website easier and more personal for you;

  • help you efficiently access your information after you sign in;

  • provide, improve, test, and monitor the effectiveness of our website;

After that, we only keep your data for statistical purposes and to handle any complaints or legal matters. 10. Who do we share your data with?

 

We may give your personal data to others. We only do this if:

  • we have received your permission to use your personal data (e.g. you are a client of a customer of us);

  • you are a customer of us.

 

More specific, after your permission we share your personal data with your trainer/coach and we share your anonymized personal data with our customers, partners and other stakeholders, only for the purposes mentioned before (see section 8) and not for other purposes.

 

11. Where do we store your data?

 

We process your data within the European Economic Area. This means that we also store your data within the EEA. However, we use Survey Monkey software to collect data via our S-COPE Monitor. Survey Monkey is an American company and stores your data on servers in the United States of America (USA). This concerns raw data that has not been edited yet. We retrieve that data and store it on European servers (Germany and/or The Netherlands) and further process your data. The USA is a country where data protection is of a comparable level to that laid down in the GDPR. In this case, an adequacy decision applies (Article 45 of the GDPR). Survey Monkey and it’s data storage falls under the agreements made in the context of the Privacy Shield Compliance between the USA and the EU. 12. How do we secure your data?

 

We have taken appropriate technical and organizational measures by using the latest technologies to protect your data against loss or unlawful processing. We use safeguards to help keep the data collected through our website/portal secure and take steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, we cannot ensure the security of any information you transmit to us or guarantee that information on our website, portal or monitor may not be accessed, disclosed, altered, or destroyed. We request you to do your part to help us. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and us, at all times. We are not responsible for the functionality, privacy, or security measures of any other organization. If you have any questions about the specific method of securing, please contact us. When we share your data with others, they are also obliged to treat it with the same care as we do. If you notice that this is not the case, please let us know.

Right to information
We must explain to you in an understandable and clear manner what we do with your data and what control you have over it. That is why we explain in detail in this Privacy Policy what data we collect from you and how we handle your data. 

 

Right to access
You may always ask us to view the data we hold about you.

 

Right to correction
You may ask us to have your data corrected if it is incorrect or incomplete. 

 

Right to object
You may object to the processing of your data if you do not agree with the way we handle your personal data. This right applies to the data we use for direct marketing. You can indicate to us that you no longer wish to receive e-mails from us. This also applies to personalized recommendations on our website. 

 

Right to data portability
If you are a customer of ours or if you have given permission for the use of your data, you may ask us to send you the digital data we have about you. This way you can transfer that data to another organization if you wish. 

 

Right to restriction
You may ask to limit the use of your data. This means that in certain cases we may only store your data but not use it. 

 

Right to be forgotten
You may ask us to delete all data we have about you. We will then delete all data that can be traced back to you. In some cases we cannot or may not yet delete your data. For example, we have to keep some data for 7 years for the tax authorities.

 

Right to withdraw consent

You may ask to withdraw your written consent to process personal data via our monitor (survey) and portal. If you withdraw, your data can be used until then, unless you also request that the data already collected must be erased. This is only possible if it does not harm the research. If not harmful, your data will be deleted as soon as possible (maximum within 5 working days). Note that your participation to fill in our survey is voluntary.

 

Right to submit a complaint
You may submit a complaint about the way in which we handle your data. If you have a complaint, we will be happy to resolve it for you. To do so, please contact  us. You may also submit your complaint to the Dutch Data Protection Authority. Of course we hope that it does not come to that, but if it's necessary you can also go to court. In that case, the court in the place of business of Maradata Holding B.V. is the one which will handle your complaint. 

 

How do I submit a request or complaint?

You can submit your request or complaint to us by sending a mail to info@s-cope.nl. We process every request or complaint within 30 days. If you submit multiple applications or complaints or if you submit a complex request or complaint, this may take more time. In that case, we will contact you within 60 days at the latest. We may ask you to identify yourself. In that case, we will ask you to submit certain information to ensure that you are the correct person whose personal data is.

 

14. What rules apply to this Privacy Policy?

 

Our Privacy Policy must meet several conditions. These conditions can be found in particular in the Dutch General Data Protection Regulation. In addition, the general rules that apply under Dutch law apply to our Privacy Policy.
 

15. Which cookies do we use?

 

You can indicate yourself what data we may use from you. If you have given us permission to personalize your profile based on your surfing and search behavior, we can set up our website specifically for you so that its use becomes easier and more personal. If you are located outside Netherlands and choose to provide data to us, please note that we transfer your data to The Netherlands.
